These Terms of Service ("Terms") govern your use of the website icleanforyou.net (the "Site") and the cleaning services provided by iClean For You ("iClean," "we," "us," or "our"). By accessing the Site or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.
1. Services Provided
iClean provides professional residential, vacation rental, and commercial cleaning services in South Florida. Our service offerings include, but are not limited to: routine (Silver, Gold, Diamond) cleaning, deep cleaning, move-in/move-out cleaning, vacation rental turnover cleaning, post-construction cleaning, office cleaning, and various add-on services.
All services are subject to availability and may vary based on property size, condition, and specific requirements. Pricing listed on the Site represents starting rates; final pricing is determined upon assessment of the scope of work.
2. Quotes and Pricing
Quotes provided through the Site or by our team are estimates based on the information provided by you. Final pricing may differ based on actual property conditions, additional services requested, or unforeseen circumstances discovered during the cleaning. We will communicate any material changes to pricing before proceeding with additional work.
Promotional pricing, discounts, or special offers are subject to specific terms and expiration dates as communicated at the time of the offer.
3. Scheduling, Cancellation, and Rescheduling
Scheduling: Appointments are confirmed upon mutual agreement of date, time, and scope of service. We strive to arrive within the communicated time window but cannot guarantee exact arrival times due to factors beyond our control.
Cancellation by Client: We request at least 24 hours' notice for cancellations or rescheduling. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee of up to 50% of the scheduled service cost, at our discretion.
Cancellation by iClean: We reserve the right to cancel or reschedule a service due to emergencies, inclement weather, staffing issues, or safety concerns. In such cases, we will notify you as soon as possible and offer an alternative date at no additional cost.
4. Access and Property Conditions
You agree to provide safe and reasonable access to the property at the scheduled time. If our team is unable to access the property as arranged, a trip fee may apply.
You are responsible for securing or removing high-value items, fragile objects, and personal belongings of significant sentimental or monetary value prior to the cleaning. iClean exercises reasonable care but is not responsible for items left unsecured in the cleaning area.
You agree to inform us of any hazardous conditions, structural issues, pest infestations, or other risks that may affect the safety of our team. We reserve the right to decline or discontinue service if conditions pose a safety hazard.
5. Satisfaction and Complaints
We are committed to delivering high-quality cleaning services. If you are not satisfied with any aspect of the service, you must notify us within 24 hours of service completion by contacting us at iclean@icleanforyou.net or (954) 326-1354.
Upon receiving a timely complaint, we will, at our sole discretion, offer to re-clean the specific area(s) of concern at no additional charge. Re-cleaning must be scheduled within 48 hours of the original service date.
Failure to report issues within the 24-hour window may limit our ability to investigate and address the concern.
6. Payment Terms
Payment is due upon completion of service unless otherwise agreed in writing. We accept all major credit cards and ACH transfers.
For recurring service clients, payment terms may be established as part of a service agreement. Late payments may result in suspension of service and may be subject to a late fee of 1.5% per month (or the maximum rate permitted by Florida law, whichever is less) on the outstanding balance.
Any chargebacks or payment disputes initiated without first contacting us to resolve the issue may result in termination of service and referral to a collections agency.
7. Liability and Limitation of Liability
iClean carries general liability insurance to cover accidental damage caused by our team during the normal course of providing cleaning services. If you believe our team caused damage to your property during a cleaning, you must report the damage within 24 hours of service completion with photographic evidence.
We are not liable for:
- Pre-existing damage, wear and tear, or defects in surfaces, appliances, or fixtures
- Damage to items not properly secured or disclosed prior to service
- Stains, discoloration, or damage caused by improper previous cleaning products or treatments applied by others
- Loss of use, lost profits, or any indirect, incidental, special, consequential, or punitive damages
To the maximum extent permitted by Florida and federal law, iClean's total aggregate liability for any claim arising out of or related to our services shall not exceed the amount paid by you for the specific service giving rise to the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless iClean For You, its owners, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) your misuse of our Site or services; (c) inaccurate or incomplete information you provide to us; or (d) any hazardous or unsafe conditions on your property that were not disclosed to us.
9. Intellectual Property
All content on the Site, including text, graphics, logos, images, and software, is the property of iClean For You or its licensors and is protected by U.S. copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.
The "iClean" name, logo, and all related marks are trademarks of iClean For You. Unauthorized use of any trademark displayed on the Site is strictly prohibited.
10. Website Use and Disclaimer
The Site is provided on an "as is" and "as available" basis. We make no warranties or representations, express or implied, regarding the accuracy, completeness, reliability, or availability of the Site or its content.
The instant quote calculator on the Site provides estimates for informational purposes only and does not constitute a binding offer or contract. Actual service pricing is confirmed upon scheduling.
We are not responsible for any errors, interruptions, or technical issues with the Site, including but not limited to chat functionality provided by third-party services.
11. Third-Party Services
Our Site may integrate with or link to third-party services (e.g., Jobber for scheduling, Tidio for chat, Google for reviews and analytics). These third-party services are governed by their own terms and privacy policies. We are not responsible for the practices, content, or availability of any third-party services.
12. Force Majeure
iClean shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to: natural disasters, hurricanes, tropical storms, flooding, pandemics, epidemics, government orders, civil unrest, power outages, or acts of God. In such events, we will make reasonable efforts to reschedule affected services.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or our services shall be resolved as follows:
- Informal Resolution: The parties shall first attempt to resolve any dispute informally by contacting iClean directly. Most concerns can be resolved quickly through direct communication.
- Mediation: If a dispute cannot be resolved informally within 30 days, either party may initiate mediation in Broward County, Florida, with a mutually agreed-upon mediator. Mediation costs shall be shared equally.
- Litigation: If mediation is unsuccessful, either party may pursue legal action. You agree that any legal proceedings shall be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of such courts.
14. Waiver of Class Action
To the fullest extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against iClean For You.
15. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and iClean For You regarding your use of the Site and our services, and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
17. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site or services after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
